In the fields of architecture and civil engineering, construction is a process that consists of the building or assembling of infrastructure. Far from being a single activity, large scale construction is a feat of multitasking. Normally the job is managed by the project manager and supervised by the construction manager, design engineer, construction engineer or project architect.

For the successful execution of a project, effective planning is essential. Those involved with the design and execution of the infrastructure in question must consider the environmental impact of the job, the successful scheduling, budgeting, site safety, availability of materials, logistics, inconvenience to the public caused by construction delays, preparing tender documents, etc.

Can I get out of a building construction contract and an agreement to purchase vacant land?
Q. My husband and I recently signed a new construction contract along with another contract to purchase vacant land in a housing development that the house is to be built on. We are in the process of applying for the new construction mortgage and we have not yet been approved. Since signing the contracts, we recently saw the first completed home in the development. We are not happy with the quality of the work by our builder and we don't want to proceed with him. We would like to build the house with another builder in another development. The land is still vacant and construction of the house is to begin after we obtain our mortgage. In the contract for purchasing the vacant land, it's stated that the sale is contingent upon the buyer… [cont.]

A. As the contract is contingent on financing, it is possible you will not qualify for the financing. But the contract undoubtedly requires you to make a good faith effort to apply for the financing. You can "get out" of any contract. It's just a matter of how much it's gonna cost you. That depends on the precise terms of your contract. Bring it to a local real estate lawyer.

What happens to construction costs in a recession?
Q. Lets say I want to construct a building, would it cost more during a recession? I was guessing less because the amount of construction people on the market is higher than usual.

A. In a recession, usually building new projects slows down. However, if building costs have lowered in price (which they havent) and construction companies are able to get financing (which they can't) then it would be prudent for construction companies to build during recessionary periods. Not all recessions are the same, is what I'm getting at. The trouble we have today for instance, is that building materials such as steel have not mellowed in price and the bank has stopped lending out money to construction companies to finance their projects. This is putting a real spur to any new projects. So in economics, it all depends on a variety of factors, there isn't usually a straight one-line answer. Hope this helps.

This is regarding construction company who failed to complete the work by the agreed date.?
Q. Both parties agreed to complete the work on average 6 to 8 weeks. Now we are on the 10th week. The work is still not yet completed. We have consulted experienced person in construction to find out how many additional weeks will be needed to complete the work. We were told that the work needs 3 to 4 additional weeks to complete. Is the construction company in breach of the contract? Can we sue this company becasue of the delay and all the problems they are causing on the family?

A. What penalty terms were put in the contract for running over the agreed dates? Yes, you could sue them for breach of contract, however, the "average" of 6 to 8 weeks is your weak point. They could argue that thisa average is based on previous jobs (although they would have to prove that too)
